النظام القانوني للمناولة في الصفقات العمومية طبقا للمرسوم الرئاسي 15/247

Résumé: ملخص: تهدف هذه الدراسة إلى معالجة النظام القانوني للمناولة في الصفقات العمومية من خلال تحليل نصوص المرسوم الرئاسي 15/247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام الناظمة لها، وذلك بإعطاء مفهوم شامل لعقد المناولة وإبراز الآثار القانونية المترتبة عليه. وتعتبر المناولة كعقد ثانوي تابع الصفقة العمومية إستراتيجية اقتصادية تدفع عجلة التنمية وتزيد النجاعة الاقتصادية في الدولة من خلال دورها الفعال في التنفيذ السريع للصفقة القائم على اعتبارات التخصص وتقسيم العمل وهذا ما جعل المشرع يعطيها اهتماما كبيرا مؤخرا خاصة من خلال المرسوم 15/247 الذي اهتم بترقيتها وتدارك النقص الذي كان حاصلا فيها. Abstract: This study aims to address the legal system for handling in public transactions by analyzing the texts of the Presidential Decree 15/247 that includes the regulation of public transactions and the mandates of the public utility that regulate them, by giving a comprehensive concept to the handling contract and highlighting the legal implications of it. Handling as a secondary contract subordinate to the public transaction, is an economic strategy that drives development and increases economic efficiency in the country through its effective role in the rapid implementation of the deal based on considerations of specialization and division of labor. This is what made the legislator give it great attention recently, especially through the Decree 15/247 which focused on promoting it and remedying the deficiency that was occurring in it.
