Résumé: ملخص إن الفساد إن استشرى في المؤسسات العامة للدولة وقطاعها الخاص يُصبح بشكل حتمي مصدرا مباشرا لوقوع انتهاكات لحقوق الإنسان تتفاوت جسامتها بأهمية الحق الذي انتهك بفعل فساد مُجرم ومعاقب عليه مسبقا في نصوص قانونية وطنية واقليمية ودولية، وبالنظر في ظروف الشخص الذي مٌنع من التمتع بهذا الحق أيا كانت طبيعته، لصالح شخص آخر فاسد استخدم نفوذه أو سلطته أو منصبه الوظيفي بشكل تعسفي من أجل تحصيل منفعة غير مستحقة قانونا له، خاصة إذا كان ضحية الفساد من الفئات المستضعفة أو الهشة الأكثر قابلية للتعرض لأثاره السلبية، بما يُثبت ضرورة الربط بين تدابير مكافحة الفساد إجراءاته والالتزام الدولي بالتمكين من حقوق الإنسان، من حيث أن كل مجتمع تحرص فيه الدولة على إيفاء التزاماتها بضمان التمتع بحقوق الإنسان واتخاذ التدابير اللازمة لمنع وقوع أي انتهاك لها، عن طريق تكريس مبادئ سيادة القانون والشفافية والمساءلة وعدم التمييز في سياق الحكم الراشد، هو مجتمع خال من الفساد.
