علاقة مكافحة الفساد بآليات حماية حقوق الانسان و حرياته

Résumé: الملخص: لقد كان تطور المؤسسات والأنظمة الدولية لمكافحة الفساد و تلك الخاصة بحماية حقوق الإنسان منعزلا أحدهما عن الآخر منذ نشأتهما ، ومع ذلك أظهرت الدراسات الحديثة الحاجة إلى دمج نهج يركز على حماية حقوق الإنسان في سياسات مكافحة الفساد، تنبع هذه الحاجة من الآثار السلبية لممارسات الفساد المؤسساتية على التمتع بحقوق الإنسان، إن الجزائر ليست محصنة ضد هذا الواقع، فهي من ناحية تواجه مشاكل فساد خطيرة لها تداعيات مهمة على حماية حقوق الإنسان، ومن ناحية أخرى، لديها أطر مؤسسية وتنظيمية تتعلق بمكافحة الفساد وحماية حقوق الإنسان، والتي تطورت بالتوازي بينهما، وبالنظر لأهمیة حماية حقوق الإنسان من الانتهاك بكل صوره و لا سيما الفساد، نتناول من خلال هاته الدراسة الطريقة التي يمكن أن تسهم بها معايير و آليات حقوق الإنسان في تحسين سياسات واستراتيجيات مكافحة الفساد و لا سيما تلك المدرجة بالدستور الجزائري . Abstract: The world has witnessed an evolution in the field of legislative and institutional systems to fight against corruption, as well as institutional and legislative protection in the discipline of human rights, recent studies have shown the need to integrate an approach focused on the protection of human rights into anti-corruption policies. This necessity stems from the harmful effects of institutional corruption practices on the enjoyment of human rights. This situation is also reflected in the Algerian reality. This article examines the methodology of incorporating human rights protection mechanisms into the anti-corruption strategy, especially those listed in the Algerian constitution.
