تعويض ضرر العدول عن الخطبة: دراسة تأصيلية في الفقه الإسلامي والتشريع الجزائري

Résumé: تتأسس الأسرة بعقد الزواج وهو من أخطر العقود؛ فيه من التكاليف و الالتزامات ماليس في غيره؛ فشرعت الخطبة كمقدمة تسبقه للتعارف بين الرجل و المرأة و ليكون كل طرف على بينة من الطرف الآخر، فالأصل في هذا العقد التأبيد، وهذا رافد يؤكد خطورة هذا العقد؛ لأن على الزوجين أن يتحمل كلاهما جميع آثاره ما أبقيا عليه، فإذا لم يحدث الانسجام و التوافق والتفاهم بين الخاطبين؛ يمكن العدول عن الخطبة من أحدهما أو كلاهما، باعتبار أن طبيعتها تختلف عن طبيعة العقد وتمنح لكل من الخاطبين الحق في إمكانية الاستمرار فيها أو التحلل من الوعد دون أن يتمكن الطرف الآخر من الاعتراض عن ذلك، وينجر عن ذلك أضرار ذات طبيعة خاصة مادية كانت أو معنوية يمكن للمتضرر حينها المطالبة بالتعويض. Abstract: The family is established by the marriage contract and it is one of the most dangerous contracts; it includes costs and obligations not otherwise. The engagement is prescribed as an introduction to the acquaintance between a man and a woman, and for each party to be aware of the other party, the basic principle in this contract is the perpetuation, This tributary confirms the seriousness of this contract. Because both spouses have to bear all of its effects what they have kept, so if harmony and understanding between the two betrothed does not occur, one or both of them can be withdrawn from the engagement. The pledge without the other party being able to object to that, and this results in damages of a particular nature, whether material or moral, in which the affected person can claim compensation
