تجريم دفع الفدية: بين الجهود الجزائرية والممارسة الدولية

Résumé: تعتبر الجزائر دفع الفدية أحد أهم المصادر لتمويل الجماعات الإرهابية، وفي إطار إستراتيجيتها الشاملة لمحاربة الإرهاب وتجفيف مصادر تمويله، بادرت إلى محاولة خلق أطر التعاون الدولي والإقليمي الرامي إلى تحديد مختلف المصادر التي تعتمد عليها الجماعات الإرهابية لتمويل نشاطاتها، ووضع التشريعات الدولية والإجراءات الضرورية وآليات التعاون الكفيلة بالقضاء عليها وتجفيفها. وتهدف هذه الدراسة للبحث في التحديات التي تواجه المقاربة الجزائرية لمكافحة الإرهاب التي تفرضها الممارسات الدولية، والتي تقدم في كثير من الحالات حق الرهينة في الحياة كأحد حقوق الإنسان التي يجب الحفاظ عليها من أجل تبرير الرضوخ لتقديم الفدية، رغم أن هذه الممارسة تسمح بتقوية الجماعات الإرهابية وتجعلها قادرة على تهديد حقوق الإنسان بصور أشد وعلى نطاق أوسع، وهو ما يبقي الجدل قائما على الساحة الدولية بخصوص نجاعة التشريعات الدولية المتعلقة بمكافحة الإرهاب الدولي وكذا الجهود الدولية والإقليمية التي تبدلها الدول في إطار سعيها الرامي للحد من نشاط الجماعات الإرهابية. Algeria considers the payment of ransom one of the most important sources for funding terrorist groups, and within the framework of its comprehensive strategy to combat terrorism and drying up its sources of financing, it has initiated an attempt to create frameworks for international and regional cooperation aimed to identify the various sources which terrorist groups depend on to finance their activities, and the development of international legislation, necessary procedures and cooperation mechanisms to ensure the elimination and drying of all the resources. This study examine the challenges facing the Algerian counter-terrorism approach imposed by international practices that provide the right of life for hostage as one of the human rights that must be preserved in order to justify the payment of ransom, although this practice allows the strengthening of terrorist groups and makes them able to threaten human rights in more severe and more widely, which keeps the debate on the international scene regarding the efficacy of international legislation related by combating international terrorism as well as international and regional efforts to limit the activity of terrorist groups.
