التأمين على الاختطاف والفدية بين الحق في الحفاظ على الأرواح ومبدأ تجريم الفدية

Résumé: : تهدف هذه الدراسة إلى تسليط الضوء على نوع قديم جديد من أنواع التأمين وهو التأمين على "الاختطاف والفدية" حيث أنه ومع انتشار الصراعات في مناطق عديدة من العالم، تسعى الجماعات الإرهابية إلى اختطاف الرهائن وطلب فديات ضخمة مقابل إطلاق سراحهم، مما قد يتسبب في عجز أسرهم ماديا، أو حتى إفلاسهم. وقد اعتمدنا على المنهج الوصفي التحليلي في تبيان أحكام هذا التأمين باعتباره آلية تعويض مادية لأسر هؤلاء المختطفين واستعراض مواقف الدول حياله، وكذا مناقشة مدى شرعيته خاصة وأنه يتأرجح بين مبدأين أساسيين في القانون الدولي وهما حماية حقوق الإنسان الأساسية وعلى رأسها الحق في الحياة ومبدأ تجريم دفع الفدية للجماعات الإرهابية في إطار تجفيف منابع تمويل الإرهاب. واختتمت هذه الدراسة بتقييم مدى احترام الدول لالتزاماتها الدولية مقابل مصالحها الداخلية. This study aims to highlight an old and relatively new type of insurance, which is “kidnapping and ransom” insurance, as with the spread of conflicts in many parts of the world, terrorist groups seek to kidnap hostages and demand huge ransoms in exchange for their release، This is what causes financial incapacity for their families and perhaps even their bankruptcy. And it relied on the descriptive and analytical approach to explain the provisions of this insurance as a mechanism for material compensation for the families of these abductees and to review the positions of states towards it, as well as to discuss the extent of its legitimacy, especially since it oscillates between two basic principles in international law, namely : the protection of basic human rights and the main one is the right to live, and the principle of criminalizing the payment of ransoms to terrorist groups within the framework of drying up the sources of financing terrorism, and I concluded this study by assessing the extent to which countries respect their international obligations in exchange for their internal interests .
