الرقابة الشرعية في البنوك الإسلاميّة بين الواقع والمأمول –تجربة مصرف السلام الجزائري -

Résumé: منذ بداياتها الأولى سنة 1975، إهتمّت المصارف الإسلامية كثيراً، بالرقابة الشرعيّة على مُعاملاتها المالية ومنتجاتها البنكيّة المختلفة؛ وهذا وعيّاً منها بأن نجاحها وإستمراريتها، مُرتبط إرتباط وثيق بإحترام مبادئ وأحكام الشريعة الإسلاميّة الغرّاء؛ وهو النهج – طبعاً – الذي تبنّته المصارف الإسلامية الجزائرية على قلّتها (البركة بنك و مصرف السلام الجزائر). وتستهدف هذه الورقة البحثيّة من خلال دراسة وتحليل تجربة مصرف السلام الجزائري، تسليط الضوء على واقع الرقابة والتدقيق الشرعي بهذا المصرف، وإبراز مكامن النقص والقصور فيها، ثم إقتراح الآليات والأدوات الكفيلة بتفعيل وتطوير وظيفة الرقابة والتدقيق الشرعي على مستوى هذا المصرف خاصةً، وعلى مستوى نظام الصيرفة الإسلامية الجزائرية عامةً. الكلمات المفتاحية: الرقابة الشرعيّة-هيئة الفتوى والرقابة الشرعيّة – الصيرفة الإسلاميّة-مصرف السلام. Abstract: Since their beginnings in 1975, Islamic banks have been very interested in the Sharia’a control of their financial transactions and their various banking products, knowing that their success and continuity are closely linked to respect for principles and rules of the Islamic Sharia’a. And this is the same path that Algerian Islamic banks have followed. (Al Baraka Bank and Al Salam Bank Algeria). This research paper, through the study applied to Al Salam Bank Algeria; aims to highlight the reality of the Sharia’a audit in this Bank, and then propose mechanisms and tools to improve and develop the function of the Sharia’a control, at the level of this bank in particular, and at the level of the Algerian Islamic banking system, in General.
