التدقيق الشرعي كآلية لتفعيل نظام الرقابة الداخلية في البنوك الإسلامية - دراسة حالة بنك الجزائري و مصرف السلام الجزائري

Résumé: ترتكز الدراسة حول توضيح مدى فعالية التدقيق الشرعي يف تقييم نظم الرقابة الداخلية للبنوك اإلسالمية، he study is based on the clarification of the extent of the forensic audit in the evaluation of internal control systems for Islamic bank and effective for it shall determine the standards of effectiveness forensic audit and of adequate autonomy for the Shari’ah Supervisory Board and a forensic audit the effectiveness of standards, foreign legal control by supervisory authorities, availability of skills and professional capacity the practitioners of the forensic audit. from these basic standard will emerge the basic components of an effective forensic audit, which will be examined and analyzed both from the theoretical side, or through applied study of the diagnosis of the Shari’ah of bank-albaraka Algerian and the Algerian Al-salam bank. and it is possible to study and assess the extent of the forensic audit to assess the internal control system of the Islamic banks effectively. من أجل ذلك وجب حتديد معايري فعالية التدقيق الشرعي واملتمثلة يف اإلستقاللية الكافية هليئة الرقابة الشرعية وجهاز التدقيق الشرعي، الرقابة الشرعية اخلارجية من طرف اجلهات اإلشرافية، توافر املهارات والقدرات املهنية لدى ممارسي التدقيق الشرعي. من خالل هذه املعايري األساسية ستتبني املكوانت األساسية للتدقيق الشرعي الفعال، اليت ستكون حمل دراسة وحتليل، سواء يف اجلانب النظري، أو من خالل الدراسة التطبيقية املتمثلة يف تشخيص الرقابة الشرعية لكل من بنك الربكة اجلزائري ومصرف السالم اجلزائري وكذلك حماولة املقارنة بينهما. من خالل تلك املعايري السابقة و إىل جانب معايري أخرى ميكن دراسة وتقييم مدى فعالية التدقيق الشرعي يف تقييم نظام الرقابة الداخلي يف البنوك اإلسالمية
