النظام القانوني لتشغيل ذوي الإحتياجات الخاصة في الجزائر

Résumé: الملخص: إن تشغيل الأشخاص ذوي الاحتياجات الخاصة يعد من الحقوق المشمولة ببالغ العناية و الإهتمام على المستويين الدولي و المحلي، و في دراستنا هذه قمنا بتحليل النظام القانوني لتشغيل هذه الشريحة في الجزائر، فبلادنا و منذ الإستقلال أدرجت التكفل بالأشخاص ذوي الإحتياجات الخاصة ضمن أولى إهتماماتها، و تجسد ذلك على مستوى مختلف تشريعاتها بدأ بمختلف الدساتير وصولا إلى صدور القانون رقم 02-09 المؤرخ في 08 ماي 2002 المتعلق بحماية الأشخاص المعوقین و ترقيتهم، و الذي يعد - إضافة إلى عديد النصوص التنظيمية - الإطار القانوني الأساسي المنظم لشؤون ذوي الإحتياجات الخاصة في الجزائر. و مــن حيث المناهج المتبعة في الدراســـة فقد شـــملت كل من المنهج الوصـفي و المنهج التحلیلي و المنهـــــج المقارن و المنهج التاريخي، حيث قمنا بدراسة النصوص القانونية المنظمة للموضوع في الجزائر الحالية منها و كذا التطـــور التاريخي و من ثم التعريج على الوضع ضمن بعض التشريعات العربية و الغربية، و على العموم خلصت الدراسة إلى تثمين الموقف الإيجابي للمشرع الجزائري في تناول الموضوع من خلال إعتماده لعديد الآليات الإدارية منها و المؤسساتية بما يوفـر الإحاطة بمختلف متطلبات هذه الشريحة، و لكن و بجانب هذه الإشادة و من خلال التعمق في ملاحظة و تحليل مختلف التدابير و الآليات المستحدثة و مقــــارنتها بالواقع المعاش من جهة، و واقـــــــع بلادنا ســـواء من حيث تركيباتها الإجتــــماعية و الثقافية و البيئة و الجغرافية من جهة أخرى، فقد سجلنا بعض النقائص في جوانب معينة من شأن إزالتها أن يعطي أبعاد إيجابية و نتائج مثمرة أكبر لمختلف الآليات و الأجـــــــــــــــهزة المقررة، و نخص بالذكــــــر في هذا المجال التمويل و النسب المقـــــــــررة للإدماج و تعميم بعض الهياكل و المؤسسات لتكوين عبر جميع ولايات الوطن و غيرها. Abstract The employment of people with special needs is one of the rights taken in consideration at the international and local levels. This study analyses the legal system for the employment of this segment in Algeria. This is at the level of its various legislations, starting with various constitutions and leading to the issuance of Law N° 02-09 of May 08th, 2002 related to the protection and promotion of persons with disabilities, which is - in addition to several regulatory texts - the basic legal framework regulating the affairs of people with special needs in Algeria. The study adopts the descriptive, the analytical, the comparative, and the historical approaches as we studied the legal texts regulating the subject in the current Algeria, as well as the historical development, and then traversing the situation within some Arab and Western legislation. In general, the study concluded that the positive attitude of the Algerian legislator in dealing with the issue was appreciated through its adoption of several administrative and institutional mechanisms, which provide an understanding of the various requirements of this segment, but besides this praise and through the in-depth observation and analysis of the various measures and innovative mechanisms and comparing them with the lived reality on the one hand, and the reality of our country, whether in terms of its social, cultural, environmental and geographical compositions on the other hand, we have recorded some deficiencies in certain aspects that their removal would give positive dimensions and greater fruitful results for the various mechanisms and established devices, In this regard, we mention in particular the funding and percentages established for integration and the generalization of some structures and institutions for training across all states of the country and others.
