تحديد معنى النماء في الزكاة - دراسة فقهية مقاصدية

Résumé: تهدف هذه الورقة إلى ضبط وتحديد مفهوم مصطلح النماء وأنواعه وأحكامه في الزكاة، فقد حمل هذا المصطح الكثير من الغموض، مما يتطلب كتابة البحوث لاستقراء حيثياته وبيان السياقات التي ورد فيها، وتقديمها في مقال يختصر ما جاء في مئات الصفحات من مصادر الفقه الإسلامي، وهذا من شأنه أن يساعد الباحثين في مجال الزكاة حتى وإن كانوا غير متخصصين في الفقه، فمصادر الفقه تحتاج لدراسات الفهرسة وضبط المصطلحات. وقد أظهرت نتائج هذه الدراسة أن النماء في الفقه الإسلامي يُطلق على ثلاثة معانٍ، معنى فقهي عام وهو أن النماء هو كل زيادة في المال، ومعنى فقهي خاص بباب الزكاة وهو أن النماء صفة في المال فيُقال لا تجب الزكاة إلا في المال النامي، ومعنى مقاصدي وهو أن النماء هو مقصد من مقاصد الزكاة، فالزكاة تحقق البركة والنماء للفرد والمجتمع، وتساهم في التنشيط الاقتصادي. كما توصلت الدراسة إلى أن النماء ينقسم إلى نماء حقيقي ونماء تقديري، ونماء متصل ونماء منفصل، كما ينقسم إلى ربح وغلة وفائدة، وقد تناولت في هذه الورقة تفاصيل كل هذه الأنوع. كلمات مفتاحية: نماء، زكاة. Abstract: This paper aims to determine the exact meaning of the term "Growth"(Al-Nama'a), its types, and its provisions in Zakat, this term had a lot of mystery, which required writing research to extrapolate its merits, and define the contexts in which it is stated, and presenting it in an article abbreviates hundred pages from the sources of Islamic Jurisprudence, this would assists the researchers in Zakat field, even if they're non-specialist in Islamic Jurisprudence. The sources of Islamic Jurisprudence needed studies to index, and adjust the terminology contained. The results of this study showed that "The Growth" (Al-Nama'a) has three meanings in Islamic Jurisprudence:(A) Fiqhi general meaning which is any increase in money, (B) meaning specific to Zakat field which is "The Growth" as a characteristic of money which is subject to Zakat, (C) Maqasidi meaning is that "The Growth" is a purpose of Zakat which achieve blessing, and growth for the individual and society, also help to economic stimulus. This study also showed that "The Growth" is divided into "Grow Actually" and "Grow Potential" (estimated), and into interconnected Growth, and separate Growth, also it divided into commercial profit (Ribh) or yield (Ghalla) or interest (Fayda).
