عقد المرابحة في ظل القانون الجزائري وتطبيقاته في المصارف - المرابحة العقارية في شباك الصيرفة الإسلامية للبنك الوطني الجزائريbna) ) نموذجا

Résumé: تهدف هذه الدراسة إلى معرفة ماهية عقد المرابحة وبيان الحكم الشرعي والنظام القانوني له كونه أكثر المنتجات التمويلية اعتمادا في المصارف والنوافذ الإسلامية خاصة مع ظهور تشريعات جديدة متمثلة في النظام 20-02 والتعليمة 20-03، ثم النظر في مدى توفر البيئة الملائمة لتطبيقه. وقد تم الوقوف على الإجراءات اللازمة لعقد المرابحة العقارية في البنك الوطني الجزائري ودراسته من الناحية الشرعية. ومما يلاحظ في النظام 20-02 والتعليمة 20-03 أن المواد القانونية مستوحاة بشكل كبير من المعيار الشرعي رقم 08 المتعلق بالمرابحة؛ وعند دراسة هذا العقد في شباك الصيرفة الإسلامية في البنك الوطني الجزائري اتضح أنه اعتمد على القوانين التي جاء بها المشرع الجزائري، لكن مما يؤاخذ عليه: اعتماد اللغة الفرنسية في الوثائق المتعلقة بالعملية وكثرة الإجراءات، وعموما البنك يعتمد بشكل كبير على المرابحة المصرفية وفق الأسس الشرعية. Abstract: This study aims to know what the Murabaha contract is and to explain the jurisprudential ruling and the legal system for it, being the most reliable financing product in Islamic banks and windows, especially with the emergence of new legislation represented in System 20-02 and Instruction 20-03, then examining the availability of a suitable environment for its application. The necessary procedures for the real estate Murabaha contract in the National Bank of Algeria were examined and studied from the legal point of view. It is noted in Regulation 20-02 and Instruction 20-03 that the legal articles are largely inspired by Sharia Standard N° 08 related to Murabaha. When this contract was studied in the Islamic banking office at the National Bank of Algeria, it became clear that it relied on the laws brought by the Algerian legislator, but what was criticized for it was: the adoption of the French language in the documents related to the process and the large number of procedures. In general, the bank relies heavily on Murabaha banking according to Sharia principles.
