Résumé: تشكل الاستثمارات الأجنبية في الوقت الحالي من بين أهم الوسائل التي تهدف لتحقيق التنمية الاقتصادية والاجتماعية للدول النامية، كما تمثل أداة فعالة في نقل المعرفة والتكنولوجيا العلمية، هذا غير أن قد يتعرض المستثمر الأجنبي عند ممارسته لمشروعه الاستثماري للمخاطر نتيجة لما تتخذه الدولة ولم يكن في الحسبان بصفتها صاحبة السيادة قد تتخذ إجراءات تؤدي حرمان المستثمر الأجنبي من ملكيته ويتكون النظام من قواعد قانونية وما يوفره من ضمانات موضوعية وإجرائية تلبي متطلبات دولية وتواكب مستجدات وتطورات تعتمدها الدولة المضيفة بهدف جذب رؤوس الأموال.
