تسوية منازعات الاستثمار الأجنبي في إطار قانون الاستثمار الجزائري

Résumé: تعتبر تسوية منازعات الاستثمارات من الضمانات التي يسعى إليها المستثمر الأجنبي، ولا سيما التحكيم التجاري الدولي، الذي يعتبر التسوية البديلة عن التسوية القضائية للنزاعات التي يكون طرفا فيها، ففي هذا المقال أردت البحث عن هذه الضمانة في التشريع الجزائري، فالهدف من هذا البحث تبيان الإجراءات القانونية التي وضعها المشرع الجزائري من أجل وضع ضمانة تبعث المستثمر الأجنبي إلى وضع الثقة في القانون الجزائري وبالتالي الاستثمار في الجزائر. لقد توصلت من خلال هذا البحث إلى أن المشرع الجزائري قد ضمن للمستثمر الأجنبي الحق في اللجوء قد ضمن للمستثمر الأجنبي الحق في اللجوء إلى التسوية البديلة وذلك شريطة وجود اتفاقية ثنائية أو متعددة الأطراف مبرمة بين الجزائر ودولة المستثمر تتضمن اللجوء إلى التسوية البديلة أو وجود بند في العقد المبرم بين المستثمر والإدارة يجيز اللجوء إلى التحكيم. The settlement of investment disputes is one of the guarantees sought by the foreign investor, in particular international commercial arbitration, which is an alternative solution to the judicial settlement of the disputes to which he is a party. put a guarantee that sends the foreign investor to trust Algerian law and thus invest in Algeria. I concluded through this research that the Algerian legislator guaranteed the right of recourse to the foreign investor. It guaranteed the foreign investor the right to resort to an alternative settlement, provided that there is a bilateral or multilateral agreement concluded between Algeria and the country of the investor that includes the use of an alternative settlement or the 'existence of an arbitration clause in the investment contract.
