خصوصية قانون مكافحة الفساد في التشريع الجزائري

Résumé: ظاهرة الفساد توصف اليوم بأنها أكبر التحديات والعقبات الحائلة دون تنمية المجتمعات وتطورها، لما تمثله من افتئات خطير على منظومة حقوق الانسان وهدر بالغ للموارد المادية والمالية للدول. والجزائر من بين الدول التي وجدت نفسها كرها في مواجهة آفة الفساد. وقد آثرت السلطات العمومية في الجزائر بدء معركتها مع الفساد بعد المصادقة على معاهدة الأمم المتحدة لمكافحة الفساد لتسن بعد ذلك القانون 01 لسنة 2006 المتعلق بالوقاية من الفساد ومكافحته، وتتبع ذلك بإصلاحات لافتة لقانون الاجراءات الجزائية وعدة قوانين ناهيك عن استحداث إطار مؤسساتي واع للمراقبة والتحري عن جرائم الفساد مما يستدعي البحث في تقييم السياسة التشريعية لمكافحة الفساد في شقيها الموضوعي والإجرائي. Abstract: The phenomenon of corruption is described today as the biggest challenge and obstacles to the development of societies, because it represents dangerous blows on the human rights system and a great waste of material and financial resources for countries. Algeria is among the countries that found themselves hatred in the face of the scourge of corruption. The public authorities in Algeria have opted to start their battle with corruption after the ratification of the United Nations Convention against Corruption, after which Law No. 01 of 2006 related to the prevention and control of corruption was enacted, followed by significant reforms to the Code of Criminal Procedure and several laws, not to mention the creation of an institutional framework that is conscious of surveillance and investigation of crimes. Corruption, whichnecessitates research in evaluating the anti-corruption legislative policy in its substantive and procedural aspects.
