شهادة الشهود كدليل إثبات في المادة الجزائية

Résumé: ملخص: تعد الشهادة في غاية من الأهمية باعتبارها وسيلة من أهم وسائل الإثبات التي يستعين بها القاضي الجزائي للوصول إلى هدفه الأساسي وهو إظهار الحقيقة, كما أنها تلعب دورا لا يستهان به في الحكم بالإدانة أو البراءة, ونظرا لما تمتاز به الشهادة؛ فقد أولى لها المشرع الجزائري اهتماما كبيرا باعتبارها من أهم أدلة الإثبات في المسائل الجزائية, كما أحاطها بإجراءات وشكليات أساسية على غرار باقي طرق الإثبات. وعليه سنحاول من خلال هذه الورقة البحثية أن نتطرق لمختلف الجوانب المحيطة بهذا الدليل الجزائي الهام؛ بعرض مفهوم الشهادة في المجال الجزائي ( مبحث أول ), ثم تناول حجية الشهادة في الإثبات الجزائي ( مبحث ثان ). Abstract: The testimony is very important as one of the most important means of evidence used by the criminal judge to reach his primary goal is to show the truth, and it plays a significant role in the judgment of conviction or innocence, The Algerian legislator gave it great attention as one of the most important proof of evidence in criminal matters, as well as basic procedures and formulations along the lines of the other methods of proof. In this paper, we will attempt to address the various aspects surrounding this important penal guide; to present the concept of martyrdom in the criminal field (first subject), and then to examine the validity of the certificate in the criminal evidence (second section).
