دور القانون الدولي في حظر المعاملات اللاإنسانية في السجون

Résumé: لكون الحرمان من الحرية هو بذاته مسبب للألم، فممارسة المعاملات اللاإنسانية يسبب للمسجون ألماً نفسياً وجسديا، ويعتبر إعتداء على الحق في السلامة الجسدية للمسجونين، مما يعكس والإستعداد للعودة للجريمة عقب الإفراج عنه؛ ومن ثم فان هناك علاقة قوية بين الضمانات المقررة للسجين المحكوم عليه والأهداف المبتغاة من العقوبة وجودا وعدما. وقد تم تناول دور القانون الدولي في حظر المعاملات اللاإنسانية في السجون في مبحثين متوافقين مترابطين، أسفرا عن أهم التوصيات المتمثلة في فكرة إنشاء منظمة عالمية للإصلاح وإعادة التأهيل الإجتماعي للمسجونين -كوكالة متخصصة مرتبطة بالمجلس الإقتصادي والإجتماعي- بصفتها تمثل الجهاز الدولي القادر على تحمل دور الأمم المتحدة التي أخذت على عاتقها قيادة الحركة الدولية في هذا المجال منذ أكثر من نصف قرن. Abstract: Because the deprivation of freedom is in itself a cause of pain, the practice of inhumane transactions causes the prisoner psychological and physical pain, and is considered an attack on the right to the physical integrity of the prisoners, which reflects the readiness to return to the crime after his release; Hence, there is a strong relationship between the guarantees established for the convicted prisoner and the desired goals of punishment, whether or not. The role of international law in prohibiting inhumane treatment in prisons was addressed in two compatible and interrelated topics, which resulted in the most important recommendations of the idea of establishing a global organization for the reform and social rehabilitation of prisoners - as a specialized agency linked to the Economic and Social Council - as representing the international body capable of bearing the role of the United Nations Which took upon itself the leadership of the international movement in this field for more than half a century
