حظر استخدام القسوة في مواجهة المسجون في القانون الدولي العام The Use Of Cruelty Against Prisoners Is Prohibited By Public International Law

Résumé: إذا كانت الجريمة هي أساس سلب الحرية فإن للسجين المحكوم عليه حقوقا يجب أن تحاط بالرعاية والعناية والضمانات الكافية حتى يعود إنسانا سويا، ومن ثم فإن هناك علاقة قوية بين الضمانات المقررة للسجين المحكوم عليه والأهداف المبتغاة من العقوبة وجودا وعدما، إذ لو نال هذه الضمانات – بحق- سوف يكفل تنفيذ العقوبة على النحو الذي قرره القانون الدولي، والذي يقتضي من بينها ضمان المعاملة الإنسانية للسجين لحمايته من استعمال المعاملة أو العقوبة القاسية أو اللاإنسانية ضده. بهذا ينبغي أن يكون احترام كرامة السجناء كبشر، هو القيمة الأخلاقية الأساسية للقائمين على إدارة المؤسسات العقابية والعاملين فيها وهذا ما قضت به المادة (10) الفقرة الأولى من العهد الدولي الخاص بالحقوق المدنية والسياسية(أعتمد بموجب قرار الجمعية العامة للأمم المتحدة 2200 ألف (د-21) المؤرخ في 16 ديسمبر1966، تاريخ بدء النفاذ: مارس 1976)، على بأنه: " يعامل جميع المحرومون من حريتهم معاملة إنسانية، تحترم الكرامة الأصلية في الشخص الإنساني. Thus, respect for the dignity of prisoners as human beings is the basic moral value of those in charge of managing penal institutions and those working in them, and this is what Article (10) of the first paragraph of the International Covenant on Civil and Political Rights stipulates: "All persons deprived of their liberty shall be treated humanely, The original dignity of the human person is respected. "
