Résumé: تقاس درجة مدى تطور الدول وتقدمها بمدى انتهاجها للديمقراطية في أنظمتها في مختلف مناحي الحياة، ويعد أحد أهم آلياتها الانتخاب، والذي يعد أعد وسائل مشاركة الشعب في السلطة والتعبير عن سيادته وتكريسها، إلا أن هذه الأداة شوهتها ولغطت صورتها جملة من الأفعال يصطلح عليها "الجرائم الانتخابية"، هذه الأخيرة تفشت بها ظواهر الفساد واستفحلت في مجتمعنا، غير إن التحولات القانونية العميقة التي أدخلت على نظام قانون الانتخاب الجزائري في مكافحة الجرائم، وإنشاء هياكل مؤسسية أصلية في مجال الوقاية والكشف عن هذه الممارسات الإجرامية، و إشراك القضاء في عملية متابعة أطوارها يشهدون على حقيقة أن الحاجة الملحة لتعبئة داخلية ودولية ضد ظاهرة الفساد الانتخابي هي ضرورة ملحة في الجزائر.
