Résumé: إن فعل الخير هو قيمة إنسانية راقية تسعى جميع المجتمعات لتحقيقها على أرض الواقع، بغض النظر عن المرجعية العقائدية الفكرية والثقافية والدينية لكافة التجمعات البشرية، ومن هنا ظهر عقد مستحدث يعرف بعقد الترست الذي كان في بدايته عقد تبرع يشبه نظام الوقف الإسلامي، في تحقيق غاية خدمة الإنسانية وتقوية اللحمة الاجتماعية، والتعبير عن سمو قيم التضامن والشعور بحاجة الآخر، وكما لعب الوقف دوره الريادي في مساندة الحضارة الإسلامية عبر تاريخها الطويل خاصة في وقت ازدهارها، فإن الواقع المعاصر لعقد الترست يشهد تطورا نوعيا لافتا، وأصبح عقدا مهما للنشاط التجاري والاستثماري، وهيمن على الساحات العالمية.
