Résumé: ملخص : نظم المشرع الجزائري الملكية العقارية الخاصة ونص على حمايتها دستوريا، كما أفرد لها نصوصا في القانون المدني وفي قانون العقوبات وكذا قانون الإجراءات المدنية والإدارية ونصوص في القوانين الخاصة، بهدف إيجاد تكامل يضمن حماية النظام العام ومنع الأفراد من أخذ حقوقهم بأنفسهم. لكن وجود كم هائل من النصوص المتعلقة بالعقار عكست سلبا على انعدام ضبط الحماية الكافية لهذه الملكية وهذا يتجلى في عدم وضوح السياسة العقارية مما ترك المجال مفتوحا لوجود مشاكل عملية على صعيد المحاكم والمجالس القضائية ونزاعات بين الأفراد والإدارة نظرا لقراراتها المتعسفة بالتعدي على أملاكهم العقارية الخاصة. الكلمات المفتاحية: الحماية؛ الملكية؛ العقارية؛ الخاصة؛ المشرع. Abstract: The Algerian legislator organized the private real estate ownership and provided for its constitutional protection, as well as provisions in the Civil Code and the Penal Code as well as the Code of Civil and Administrative Procedures and the provisions of the special laws aimed at achieving integration that guarantees the protection of public order and preventing individuals from taking their rights themselves. But the existence of many laws regarding real estate reflected negatively on the lack of adequate protection for this property, which is reflected in the lack of clarity in real estate policy, leaving the possibility open for practical problems at the level of courts, judicial councils and disputes between individuals and administration due to its arbitrary decisions to infringe on their own real estate properties.
