الضمانات القضائية لحق الملكية العقارية الخاصة

Résumé: كرس المشرع حق الملكية العقارية الخاصة، وأحاطه بحماية قضائية واسعة تمنع وتردع كل مساس بهذا الحق، حيث وضع في يد مالك العقار مجموعة من الدعاوى المدنية تتمثل أساسا في دعوى إستحقاق الملكية ودعوى منع التعرض للملكية وكذلك دعوى وقف الأعمال الجديدة، ودعوى جزائية تتعلق بردع جريمة التعدي على الملكية العقارية، ضف إلى ذلك دعاوى إدارية تحمي مالك العقار من تدخل وتعسف الإدارة تتمثل في دعوى الإلغاء ودعوى التعويض، تتيح له هذه الدعاوى الدفاع عن حق ملكيته العقارية من كل تعرض أو تهديد أو إعتداء أو تعدي، وكذلك من كل تدخل أو ضرر ناتج عن الأفراد أو الإدارة، ذلك أن هذه الدعاوى تعد أقوى الضمانات التي خصها المشرع لحماية حق الملكية العقارية الخاصة. Abstract: The legislator devoted the right to private real estate ownership and informed him that it was abroad judicial and prevented any prejudice to this right, as he placed in the owner of the owner of a group of civil asuits that are entited to a claim for entitlement to property and a lawsuit to prevent exposure to ownership as will as a lawsuit to stop anew business and a criminal case including with deterrence the crime of infringement of real property in addition to administrative cases that protect the property owner from interfence and arbitrariness of the administrative in the cancellation and compensation lawsuit you can have these actions defending the right to real estate ownership from every exposure, threat, attack or infringement, as will as from every interference or damage resulting from individuals or management, as these claims are the strongest guarantees that the legislator has allocated to protect the right to private real estate ownership.
