اِكتساب الجنسية عن طريق الزواج المختلط

Résumé: لقد واكب المشرع الجزائري مختلف التشريعات المقارنة من خلال تحديده لمسألة الزواج المختلط كآلية لاِكتساب الجنسية، حيث يهدف موضوع الدراسة إلى تحقيق جملة من الشروط والآثار المترتبة عن اِكتساب الجنسية عن طريق الزواج المختلط، كما كشفت ورقتنا البحثية دراسة تحليلية للمادة 09 مكرر من قانون الجنسية الجزائرية مع التطرق إلى موقف بعض التشريعات المقارنة. واِنتهت الدراسة إلى تحديد الأثر المترتب عن جنسية الزوجة على جنسية الزوج في إطار الزواج المختلط مع تحديد موقف المشرع الجزائري من فكرة تبعية الأبناء لجنسية الأب أو الأم المكتسبة عن طريق الزواج المختلط وكذا تعدد الجنسيات المكتسبة عن طريق الزواج المختلط The Algerian legislator has kept pace with the various comparative legislations by defining the issue of mixed marriage as a mechanism for acquiring nationality, where the subject of the study dealt with clarifying the conditions for acquiring nationality through mixed marriage and its implications, as our research paper revealed an analytical study of Article 09 bis of the Algerian Nationality Law with an address to the position Some comparative legislation. The study ended with determining the impact of the wife's nationality on the husband's nationality in the context of mixed marriage, with determining the position of the Algerian legislator on the idea of the subordination of children to the nationality of the father or mother acquired through mixed marriage, as well as the multiplicity of nationalities acquired through mixed marriage
