إشكالات تنازع القوانين حول حضانة الأطفال في إطار الزواج المختلط (دراسة مقارنة) Problems Of Conflicting Laws On Child Custody In Mixed Marriage (comparative Study)

Résumé: الملخص: إنّ الحضانة من المسائل الحيوية والهامّة في مجال مسائل الأسرة، لاسيما بعد انحلال الزّواج، ومن ثمّة لا إشكال يطرح حينما يكون انحلال الزّواج بين زوجين يحملان نفس الجنسية ويقيمان بصفة دائمة داخل الوطن الذّي ينتميان إليه بجنسيتهما، لكّن الإشكال يطرح في حالة الزّواج المختلط والتّنازع حول القانون الواجب التّطبيق على حضانة الأولاد النّاتجين عن ذلك الزّواج، أي أن يكون أحد الزّوجين أجنبيا أو كلا الزّوجين من جنسيتين مختلفتين أو كلّ من الزّوجين عديم الجنسية، وهذا ما يضعنا أمام تنازع القوانين؛ ممّا يستوجب اختيار القانون الأنسب من بين القوانين المتزاحمة، في هذه الحالة يثور التّساؤل عن القانون الواجب التّطبيق على مسألة حضانة الطّفل بناء على أحكام التشريعات العربية والتشريع الجزائري والإجتهاد القضائي للمحكمة العليا. الكلمات المفتاحية: الزواج المختلط، الحضانة، تنازع القوانين، التشريعات المقارنة. Summary: Custody is a vital and important issue in the field of family matters, especially after the dissolution of marriage. There is no problem when the dissolution of marriage is between a couple of the same nationality and resides permanently within the country to which they belong, but in the case of mixed marriage and conflict over the law. The custody of the children resulting from that marriage must be applied, i.e., one foreign spouse or both spouses of different nationalities or both spouses are stateless, which places us in the face of conflict of laws; In this case, the question of the law applicable to the issue of child custody arises in accordance with the provisions of Arab legislation, Algerian legislation and the jurisprudence of the Supreme Court.
