مبدأ سيادة البرلمان في اعداد القوانين والتصويت عليها في القانون الجزائري

Résumé: تضمن المؤسس الدستوري الجزائري النص في المادة 112 من الدستور على مبدأ سيادة البرلمان في إعداد القوانين والتصويت عليها، إلا أنه رجح كفة السلطة التنفيذية على كفة السلطة التشريعية في أغلب مراحل العملية التشريعية، لاسيما المبادرة بالقوانين التي تأخذ في الغالب شكل مشاريع القوانين على حساب اقتراحات القوانين، وأيضا بخصوص إتمام العملية التشريعية مثل الاعتراض على القوانين وإصدارها. كما لم يضمن المؤسس الدستوري في باقي نصوص الدستور مساواة حقيقية بين غرفتي البرلمان، بالرغم من احداثه في تعديل 2016 مساواة بين الغرفتين بخصوص التصويت على القوانين. و قيد المؤسس الدستوري البرلمان وخصوصا في القوانين العضوية عندما ألزم عرضها على المجلس الدستوري ليمارس عليها رقابة مطابقة مع الدستور، هذه الرقابة بالإضافة إلى رقابة الدستورية تعد آليات تمكن المجلس الدستوري من التدخل في صياغة النص القانوني أو استبعاده كليا لعدم دستوريته أو عدم مطابقته للدستور The Algerian constitutional founder included in article 112 of the constitution stipulating the principle of the supremacy of Parliament regarding preparing laws and voting on them. And also regarding the completion of the legislative process, such as challenging and promulgating laws. The constitutional founder also did not guarantee in the rest of the provisions of the constitution real equality between the two chambers of parliament, despite its events in the 2016 amendment, equality between the two chambers with regard to voting on laws. And the constitutional founder restricted parliament, especially in the organic laws, when he made it necessary to present it to the Constitutional Council in order to exercise identical oversight on it. This oversight and constitutional oversight are mechanisms that enable the Constitutional Council to interfere in drafting the legal text or excluding it entirely because it is unconstitutional or not in conformity with the constitution
