الصكوك الإسلامية كأداة لتنشيط الفرص التمويلية البديلة للمشاريع الإقتصادية في الجزائر

Résumé: "الملخص: تقدم الصكوك الإسلامية وبأشكالها المختلفة مساهمات إيجابية من شأنها تعزيز التنمية الاقتصادية والدفع بعجلة الاقتصاد إلى الأمام، كما تحقق للأفراد والمؤسسات والمستثمرين فيها والمصدرين لها أثار إيجابية تعود بالفائدة على المجتمع، لذلك نجد الاهتمام الكبير من قبل الباحثين والاقتصاديين والفقهاء المسلمين بتطوير سوق الصكوك الإسلامية لما لها من فوائد اقتصادية. تعد الصكوك الإسلامية من أبرز منتجات الصناعة المالية الإسلامية، وفي ظل التوجه العالمي نحو الصكوك الإسلامية تبرز أهمية الدور الملقى على عاتق الهندسة المالية الإسلامية للتعامل مع إشكالية مخاطر تلك الصكوك. وفي هذا الإطار يأتي هذا البحث الذي يسعى للتعرف على الصكوك الإسلامية من حيث مفهومها، وخصائصها وأنواعها، ومخاطرها، وأنواع تلك المخاطر ومصادرها، ووضع آليات لمعالجة تلك المخاطر اعتمادا على أدوات الهندسة المالية الإسلامية، حيث برزت هذه الصكوك كواحدة من أهم منتجات الصناعة المصرفية الإسلامية إن التمويل الإسلامي متاح للدولة الجزائرية، خاصة في ظل العجز الذي تعاني منه في موازنتها العامة، وأخيرا ينبغي على الجزائر إصدار قوانين خاصة بالمصارف الإسلامية والأسواق المالية الإسلامية حتى يتسنى لها الخروج من الأزمات الإقتصادية التي تمر بها.""Abstract The Islamic Instruments with and its various forms make positive contributions that will enhance economic development and push the economy forward. It also achieves for individuals، institutions، investors and exporters with positive effects that benefit society. Therefore، we find great interest on the part of Muslim researchers، economists and jurists to develop the Islamic bond market because of its Economic benefits Islamic Sukuk are considered as one of the main products of Islamic financial industry. Given the paramount importance of Sukuk all over the world، The Islamic financial engineering has to deal with the risk of these Sukuk. This research، which comes out as result of this problem، aims at knowing and understanding Islamic Sukuk. It will look at their concept، characteristic، types، risks and the types of these risks and their resources. The research will set up a mechanism for treating these risks depending on the tools of Islamic financial engineering، these sukuk have emerged as one of the most important products of the Islamic banking industry. Islamic finance is available to the Algerian state، especially in light of the deficit that it suffers from in its general budget. Finally، Algeria should issue laws for Islamic banks and Islamic financial markets so that it can get out of the economic crises it is going through."
