دور المحكمة الدستورية في حماية مبدأ الأمن القانوني The Role Of The Constitutional Court In Protecting The Principle Of Legal Security

Résumé: تهدف هذه الدراسة إلى البحث عن السبل والآليات التي تستعملها المحكمة الدستورية الجزائرية في حماية مبدأ الأمن القانوني، حتى يضمن الأشخاص استقرارا لأوضاعهم القانونية. لقد خلصنا إلى أن دور المحكمة الدستورية في حماية مبدأ الأمن القانوني لا يقتصر على النصوص القانونية، من خلال إلزامها بضرورة الموازنة بين أثر الحكم بعدم الدستورية وحق الأشخاص في استقرار مراكزهم القانونية واحترام حقوقهم المكتسبة، بل يتعداه إلى قدرة القاضي الدستوري على الاجتهاد عبر تقنية التحفظات التفسيرية، وهذا من دون أن يخالف الإرادة الحقيقة للمشرع. This study aims to search for the means and mechanisms that the Algerian constitutional court uses to protect the principle of legal security, so .that people can guarantee stability in thier legal status We concluded that the role of the Algerian constitutional court in protecting the principle of legal security is not limited to legal texts, by obliging it to balance the impact of the unconstitutionality ruling and the right of persons to stabilize thier legal position and respect thier acquired rights ; but rather to the constitutional judge’s ability to make jurisprudence from through the technique of interpretative reservations, and this without .contradicting the true will of the legislator
