حماية الطرف الضعيف- المؤمن له- في عقد التأمين

Résumé: ملخص: يعتبر المؤمن له طرفا ضعيف في عقد التأمين، و على هذا الأساس سعى المشرع إلى تقرير حماية له، في مواجهة الطرف القوي- المؤمن-، وذلك من خلال إقرار مجموعة من الآليات و التقنيات القانونية التي من شأنها توفير أكبر قدر من الحماية. و ذلك بموجب الأحكام العامة التي يتضمنها القانون المدني، لاسيما تلك المتعلقة بعقد الإذعان، و بموجب الأحكام الخاصة الواردة في قانون التأمين و قانون الاستهلاك. هذه الحماية تشمل جميع مراحل عقد التأمين من المرحلة السابقة عن العقد إلى غاية مرحلة التنفيذ. Summary: The insured is considered a weak party in the insurance contract, and on this basis the legislator sought to determine protection for him, in the face of the strong party - the insurer - by adopting a set of legal mechanisms and techniques that would provide the greatest amount of protection. And according to the general provisions contained in the civil law, especially those related to the contract of compliance, and in accordance with the special provisions contained in the insurance law and the consumption law. This protection includes all stages of the insurance contract from the previous stage of the contract to the stage of implementation.
