الخبرة القضائية في المجال البنكي

Résumé: يكتسي موضوع الدراسة أهمية كبيرة في الجانب التعاملات البنكية ، خاصة منها التعاملات المالية و الفنية ، و عليه كان على الخبرة القضائية الدور الفعال للفصل في هذه المسائل التي قد تكون عائق أمام المؤسسة البنكية سواء في حالات العادية أو حالة وقوع نزاع ، خاصة ما تعلق منها بإثبات الخطأ العقدي أو التقصيري و الضرر الناجم عنه، و إثبات أركان الجريمة بعناصرها و شروطها و إعطائها الوصف القانوني الصحيح من اجل إسناده لمرتكبها ، مع تحديد المركز القانوني للبنك في كل الحالات : Abstract: udy is of great importance in the aspect of banking transactions, especially financial and technical transactions, and accordingly the judicial experience had an effective role in adjudicating these issues that may be an obstacle to the banking institution, whether in normal cases or in the event of a dispute, especially those related to proving The contractual or negligent error and the damage resulting from it proving the elements of the crime with its elements and conditions and giving it the correct legal description in order to attribute it to the perpetrator, with the identification of the legal position of the bank in all cases
