اجراءات اشراف قاضي تطبيق العقوبات على تنفيذ الأحكام الجزائية

Résumé: يعتبر قاضي تطبيق العقوبات مؤسسة قضائية تتولى الإشراف على تنفيذ اللأحكام الجزائية كما تتولى الاشراف على أساليب تهذيب النفوس وطرق العلاج العقابي وفي هذا الصدد تقوم بإتباع اجراءات محددة في اتخاذ القرارات وكذلك في تطبيقها وتقوم هذه المؤسسة بمهامها تحت اشراف لجنتين هما لجنة تطبيق العقوبات ولجنة تكيف العقوبات غير انه من الناحية العملية فان قرارات قاضي تطبيق العقوبات في القانون الجزائري هي قرارات استشارية وهذا بخلاف القانون الفرنسي فان قرارات قاضي تطبيق العقوبات هي قابلة للطعن أمام محكمة تطبيق العقوبات وغرفة تطبيق العقوبات وخاصة في الحالات الماسة بحرية الأشخاص. Abstract: The judge of the application of sanctions is a judicial institution that supervises the implementation of penal provisions. It also supervises the methods of disciplining people and methods of penal treatment. In this regard, it follows specific procedures in the adoption of decisions as well as in their application. This institution performs its tasks under the supervision of two committees: However, in practice, the decisions of the magistrate in the Algerian law are advisory decisions. In contrast to French law, the decisions of the judge of the application of the penalties are subject to appeal before the court of application of penalties and the chamber of application of penalties, Urgent freedom of persons.
