بين تكريس حرية الرأي و التعبير و حماية المقدسات الدينية: أي دور للمحكمة الأوربية لحقوق الإنسان؟ / Between The Consecration Of Freedom Of Opinion And Expression And The Protection Of Religious Sanctities: What Role For The European Court Of Human Rights?

Résumé: تعد حرية الرأي و التعبير من الحريات الأساسية التي تشكل ركائز المجتمع الديمقراطي، و شرطا لا غنى عنه لتحقيق النمو الكامل للفرد، لئن في الحقيقة، فأن هذه الحرية متى تم ممارستها بصفة مطلقة، قد تتحول إلى فوضى و تؤدي إلى الحض على الكراهية و العدوان بسبب مساسها بحريات أخرى، لا سيما تلك المتعلقة باحترام المقدسات الدينية. لذلك حاول القانون الدولي من خلال مختلف قواعده و مؤسساته الموازنة بين ضمان ممارسة هاتين الحريتين بصورة فعلية. و لعل المحكمة الأوربية لحقوق الإنسان، باعتبارها حامي النظام العام في أوربا، تمثل و لو بصورة جزئية، عن طريق اجتهادها القضائي الغزير، مثالا يستحق إتباعه في هذا المجال، نظرا لتكريسها نوعا من الحماية النسبية للمقدسات الدينية، بما في ذلك الإسلامية، في مواجهة حرية الرأي و التعبير. Freedom of opinion and expression are among the basic freedoms that constitute the pillars of a democratic society, and an indispensable condition for achieving the full growth of the individual. However, this freedom, when exercised absolutely, may turn into chaos and lead to incitement to hatred and aggression due to an infringement on other freedoms such as those related to respect for religious sanctities. Therefore, international law has tried, through its various rules and institutions, to balance between ensuring the effective exercise of these two freedoms. The European Court of Human Rights, as the guardian of public order in Europe, could- at least partially- be, through its abundant jurisprudence, an example worthy of being followed in this field, given that it consecrates a form of relative protection for religious sanctities, including Islamic ones, when facing freedoms of opinion and expression.
