استثمار الممتلكات الثقافية العقارية في إطار المنظومة القانونية الوقفية

Résumé: أحالت أحكام المادة الرابعة من القانون 98-04 المتعلق بحماية التراث الثقافي، تسيير الممتلكات الثقافية الوقفية إلى قانون الأوقاف، بما يجعل من آليات تثمير وحماية هذه الممتلكات متكفلا بها ضمن أحكامه التي وجب أن تؤسس لقواعد لها دور رئيسي على محور العلاقة ممتلك ثقافي-وقف، والغائب لحد الساعة عن مشهد هذه المنظومة القانونية المتخصصة، بالشكل الذي لم تعد فيه حاجة إصلاح هذا الشق مجرد خيار بل أضحت حتمية تدفعنا اليوم أكثر من أي وقت مضى لاقتراح آليات قانونية أكثر فعالية لتثمير الممتلك الثقافي ودفعه للانخراط في جهود التنمية الاقتصادية المستدامة في هذا المجال. The provisions of 4th Article of 98-04’s act relating to the cultural heritage’s protection has referred the management of Waqf cultural property to the Waqf legal system, thus making the development, investment and protection mechanisms of these properties included within the provisions of this system; In the form that establishes the details of a fundamental role on the axis of the relationship cultural property-Waqf, which represents a scene absent until now from this specialized legal system, In the manner that the need to reform this part of this legal waqf system has not remained a mere option, but has become an imperative, that pushes us today more than ever before, to propose more effective specialized legal mechanisms to engage in the sustainable economic development efforts in this context.
