Résumé: ملخص: يعد استثمار الأملاك العقارية الموقوفة من الآليات القانونية التي تؤدي للحفاظ عليها و استمراريتها، كما يسمح بتمويل الخزينة العمومية وتدعيم التنمية المحلية، لذلك فقد أولى المشرع أهمية خاصة في محاولة منه لتنظيم هذا الاستثمار وترقيته.و ذلك في إطار توجه الدولة نحو التوسيع في عملية استثمار العقارات الوقفية . لذلك فقد أقر المشرع أسلوبا جديدا لاستغلال العقارات الوقفية الموجهة للاستثمار، و ذلك من خلال عقد جديد أطلق عليه اسم " العقد الإداري للاستثمار " و الذي له أهمية كبيرة في مساهمة القطاع الوقفي في التنمية الاقتصادية ، بعدما عانت العقارات الوقفية من الإهمال والركود.
