الآليات القانونية للتسوية القسمة القضائية العقاريــة في التشريع الجزائري

Résumé: يثير المال الشائع العديد من المشاكل في الحياة العملية فهو حالة غير مرغوب فيها تتشابك فيها سلطات الشركاء على العقار الشائع بينهم ،ويبقى الحل الأمثل لإنهاء هذه المشاكل و إزالة الشيوع القسمة القضائية بإعتبارها وضع من الأوضاع القانونية التي أقرها المشرع للفصل في كل خصومة يمكن أن تنشأ بين الشركاء في الشيوع بشأن هذه الملكية أو لوجود قاصر بين الشركاء طالبي القسمة القضائية. يهتم هذا البحث بدراسة الآليات القانونية التي أقرها المشرع الجزائري لتسوية القسمة القضائية ، فهي حق مكفول بموجب القانون ،لأنه يمثل الوسيلة الأنجع لإزالة الشيوع لما تحويه من حل للنزاعات والمشاكل التي يثيرها هذا الأخير . Common money raises many problems in working life, as it is an undesirable situation in which the powers of partners over the common property are intertwined between them, and the best solution remains to end these problems and eliminate the commonality of judicial division as one of the legal statuses approved by the legislator To settle every dispute that may arise between the common partners regarding this ownership or because of the presence of a minor between the partners requesting the judicial division. This research is concerned with studying the legal mechanisms approved by the Algerian legislator to settle the judicial division, as it is a right guaranteed by law, because it represents the most effective way to eliminate commonness because it contains a solution to the disputes and problems raised by the latte
