Résumé: تهدف هذه الدراسة إلى تسليط الضوء على الضمانات القانونية التي قررها المشرع الجزائري لدانين في القسمة القضائية للعقار الشائع في مواجهة الشركاء في الشيوع والتي تكمن في حق الدائنين في التدخل في إجراءات القسمة القضائية للعقار الشائع . ومن أهم النتائج المتوصل إليها هي أنه يجوز لدائنين التدخل في إجراءات القسمة القضائية سواء عن طريق المعارضة أو يتم إدخالهم من قبل الشركاء ،حيث تكون القسمة غير نفاد في حق الدائنين المعارضين أو المقيد حقوقهم قبل رفع الدعوى في حالة عدم إدخالهم في إجراءات القسمة القضائية العقار الشائع .
