الإحتجاج بالسر المهني أمام الإدارة الجبائية: السر الطبي وسر المحامي نموذجا

Résumé: يقع على عاتق أصحاب المهن (الأطباء والمحامون نموذجا) التزام بحفظ السر المهني وعدم إفشائه تحت طائلة العقوبات المنصوص عليها قانونا. وتهدف الدراسة إلى التوفيق بين المصلحة العامة في ضمان الديون الضريبية و المصلحة الخاصة في حماية أسرار المرضى والموكلين من الإفشاء. يخضع كل من السر الطبي وسر المحامي استثناء للكشف وعدم الإحتجاج بهما أمام الإدارة الجبائية تحقيقا للصالح العام، من دون أن يؤدي ذلك إلى نسف نظرية السر المهني نهائيا، إذ بتم هذا الكشف في حدود ووفقا لضمانات متعددة. Professionals (doctors and lawyers, as a model) have an obligation to keep a professional secret and not divulge it under penality of penalties stipulated in the law. The study aims to reconcile between the public interest in securing tax debts and the private interest in protecting patients and clients secrets from disclosure. Both the medical Secret and the lawyer’s secret are Subject to an exception for Disclosure and not to be invoked befor the Tax Administration in order to achieve the public interest, without this leading to the torpedoing of the Professional Secret theory forever, as this Disclosure is carried out within limits and according to multiple Guarantees.
