السلطة العليا للشفافية والوقاية من الفساد و مكافحته-قراءة في القانون رقم 22/08 الصادر بتاريخ 05 ماي سنة 2022-

Résumé: أنشئت السلطة العليا للشفافية والوقاية من الفساد ومكافحته بمقتضى التعديل الدستوري 2020 التي حلت محل الهيئة الوطنية، وبصدور القانون 22/08 الذي يحدد تنظيمها وتشكيلها وصلاحياتها، تم تزويدها بتشكيلة جديدة ضمت شخصيات مختلفة تساهم في تنفيذ برنامجها، من بينهم قضاة وشخصيات من المجتمع المدني وتكلف هذه السلطة بصلاحيات عديدة تجمع بين الوقاية والمكافحة، من خلال قيامها بمساعدة الإدارات العمومية والأشخاص في الوقاية من الفساد، وتولي التحريات الإدارية والمالية لبعض صور جرائم الفساد، والسؤال المطروح في هذا المقام، كيف نظم القانون 22/08 السلطة العليا للشفافية والوقاية من الفساد ومكافحته؟ ومن خلال البحث توصلنا إلى مجموعة النتائج أهمها أن التشكيلة والصلاحيات الجديدة للسلطة العليا تمكنها من تحقيق غرضها الأساسي، خاصة أنها عملت على إشراك المجتمع المدني بنشاطاته في مجال الوقاية من الفساد. The Supreme Authority for Transparency, Prevention and Control of Corruption was established under the Constitutional Amendment 2020, which replaced the National Authority, and with the issuance of Law 22/08 that defines its organization, formation and powers, it was provided with a new assortment that included various personalities who contribute to the implementation of its programme, including judges and personalities from civil society. The authority has many powers that combine prevention and control, through its assistance to public administrations and persons in the prevention of corruption, It undertakes administrative and financial investigations for some forms of corruption crimes. The question in this regard is how Law 22/08 organized the supreme authority for transparency, prevention and control of corruption? Through the research, we reached a set of results, the most important of which is that the new formation and powers of the Supreme Authority enable it to achieve its main purpose, especially as it worked to involve civil society in its activities in the field of corruption prevention.
