إجراءات حجز العقارات غير المشهرة في القانون رقم 08/09

Résumé: الملخص: يهتم المقال بدراسة الحجز على عقار غير مشهر، و يظهر الهدف منه كون ان الحجز العقاري في حد ذاته اجراء خطير يمس بأصل الملكية ، ناهيك ان العقار غير المشهر يطرح عدة اشكالات لأنه لا يملك بطاقة على مستوى المحافظة العقارية وهو اجراء استثنائي لم يكن موجودا في القانون الملغى، وانما تكرس بموجب القانون رقم 08/09، اما عن اهم النتائج فهي تتمثل في الاجراءات المستحدثة التي وضعها المشرع لتوقيع حجز على عقار غير مشهر. Abstract : The article is concerned with studying the seizure of a property that is not known, and the aim of it appears that the real estate seizure in itself is a dangerous procedure that affects the origin of the property, not to mention that the unpublished property raises several problems because it does not have a card at the level of the real estate governorate, which is an exceptional procedure that was not present in the law Canceled, but it was established according to Law No. 09/08. As for the most important results, it is represented in the new procedures put in place by the legislator to sign a seizure on a non-publicized property.
