الحجز العقاري في التشريع الجزائري The Booking Real Estate In Algerian Legislation

Résumé: الملخص: نهدف من خلال هذه الدراسة إلى محاولة تسليط الضوء على الحجز العقاري بإعتباره وسيلة من وسائل التنفيذ الجبري على أموال المدين، تمكن الدائن من وضع عقارات أو حقوق عينية عقارية مملوكة لمدينه أو لغيره تحت يد القضاء تمهيدا لبيعها بالمزاد العلني، ويعد الحجز العقاري من المواضيع التي وضع لها المشرع الجزائري القسط الأكبر من الاهتمام بموجب القانون09/08 المتضمن قانون الإجراءات المدنية والإدارية، وذلك لمساسه بحق الملكية المكرس دستوريا، وهذا على أساس تميزت إجراءات الحجز على العقار في قانون الإجراءات المدنية القديم بالتعقيد وطول المواعيد وفي بعض الحالات بالتعجيز، لكن بصدور القانون الجديد تم التخفيف من تعقيد هذه الإجراءات وتوسيع نطاق الحجز ليشمل إلى جانب العقارات، الحقوق العينية العقارية المشهرة، وكذلك إمكانية توقيع الحجز على العقارات غير المشهرة. Abstract: Through this study we aim to highlight of real estate seizure is one of the means of forced execution on the debtor's funds, enabling the creditor to put real estate or real property rights owned by the city or others in the hands of the judiciary in preparation for sale by auction. 09/08 which contains the code of civil and administrative procedures, in violation of the constitutionally enshrined right of ownership; this is on the basis of the procedures of seizure of the property in the old civil procedures law was complicated and lengthy and in some cases incapacitated, but with the issuance of the new law was eased the complexity of these procedures and the extension of the scope of custody to include in addition to real estate, property rights famous, as well as the possibility of signing reservation of non- famous properties.
