حماية ضحايا جرائم الاختطاف في القانون الجزائري

Résumé: تناولت الدراسة الحماية القانونية المقررة لضحايا جرائم الاختطاف، والتي أوردها المشرع الجزائري في قانون الوقاية من جرائم اختطاف الأشخاص ومكافحتها، ومنها بذل الجهود للعثور على الضحية وهي على قيد الحياة، التكفل النفسي والصحي والاجتماعي، تيسير اللجوء إلى القضاء والاستفادة من المساعدة القضائية، مساعدة أسر الضحايا، بالإضافة إلى التدابير الإجرائية وغير الإجرائية المقررة لحماية الضحايا والشهود والخبراء، المنصوص عليها في قانون الإجراءات الجزائية، وهذه الحماية تقررت بعد أن أضحى موضوع حماية الضحايا من مرتكزات السياسة الجنائية الحديثة، في محاولة منها لخلق نوع من التوازن في الحماية بين طرفي الجريمة. Abstract : The study deals with the legal protection mandated by the Algerian legislator in the law on preventing and combating the crimes of persons abduction, including making efforts to find the victim alive, providing psychological, health and social support, facilitating the resorting to justice and benefiting from legal assistance, assisting the victims’ families, in addition to the procedural and non-procedural measures established for the protection of victims, witnesses and experts, stipulated in the Code of Criminal Procedures. This protection was decided after the issue of protecting victims became one of the pillars of modern criminal policy, in an attempt to create a balance in protection between the two parties to the crime.
