التدابير الوقائية الإجرائية والعقابية لجرائم المضاربة غير المشروعة

Résumé: العمل التجاري والرغبة في المنافسة وتحقيق الربح هي أمور فطرية جبل عليها الإنسان منذ الأزل إلى يومنا هذا، والقانون لا يعارضها أو يلغيها بالعكس قد كان حريصا دوما على حماية هذه المبادئ واحترامها، إنما هو يعارض إساءة استعمالها و استغلالها في ممارسات خارجة عنه وغير مشروعة، تؤدي إلى الإضرار بالمستهلكين وتدمير الاقتصاد الوطني الهش بطبيعته في وقت تسعى الدولة جاهدة للوقوف به و تقويته وتدعيمه، تنظيم الأسواق التي تعيش حالة من الفوضى واضطرابات غير طبيعية ونقص في التموين ، هذا ما دفع بالمشرع الجزائري الى وضع تدابير وقائية وصياغة آليات إجرائية وتبني سياسة عقابية لمكافحة جرائم المضاربة غير المشروعة. Abstract: Business and the desire to compete and make a profit are innate matters on which man has from time to time immemorial and the law does not oppose or repeal them on the contrary has always been keen to protect and respect these principles, It is opposed to abuse and exploitation in practices outside of it and unlawful as the State end eavours to stand up to, strengthen and strengthen the country's inherently fragile economy, Regulation of markets in chaos, abnormal disturbances and supply shortages prevention measures and the formulation of procedural mechanisms and the adoption of a punitive policy to combat illicit speculative crimes
