ضمانات نزاهة وشفافية العملية الانتخابية في ظل الأمر رقم 21-01 المتعلق بنظام الانتخابات

Résumé: إن النظام الانتخابي ينبغي أن يستوحي وجوده من الواقع، ومن ظروف البيئة السياسية والاجتماعية، بحيث يتعين أن يكون متوافقا ومتماشيا مع طبيعة الشعب وظروفه. حتى يشهد التطبيق ذلك، فلا بد من توافر ضمانات حقيقية تتقرر لسلامة العملية الانتخابية ونزاهتها وحيادها، من بداية تنظيمها الى الاعلان عن النتائج النهائية. تكون هذه الضمانات في مرحلة الاعداد والتحضير، وفي مرحلة اجراء العملية الانتخابية، وفي مرحلة اعلان النتائج، سنبين هذه الضمانات من خلال الضوابط والقيود التي جاء بها الأمر 21-01 المتعلق بقانون الانتخابات، لنخلص أن الوعي العام السياسي للمواطن والمترشح هو الأداة الفعالة لضمان سلامة الانتخابات ونزاهتها، وأن الإشراف القضائي على العملية الانتخابية هو الضمان الحقيقي لنزاهة العملية بسبب حياد السلطة القضائية. Abstract: The electoral system should derive its existence from reality, and from the conditions of the political and social environment, so that it must be compatible and compatible with the nature and circumstances of the people. In order for the application to witness this, there must be real guarantees that are determined for the integrity, integrity and impartiality of the electoral process, from the beginning of its organization to the announcement of the final results. These guarantees are in the stage of preparation, in the stage of conducting the electoral process, and in the stage of announcing the results. We will clarify these guarantees through the controls and restrictions set forth in Ordinance 21-01 related to the election law, to conclude that the political public awareness of the citizen and the candidate is the effective tool to ensure the integrity of the elections. And its integrity, and that judicial supervision of the electoral process is the real guarantee of the integrity of the process due to the impartiality of the judiciary.
