الشروط القانونية لحجية التوقيع الإلكتروني

Résumé: يعتبر التوقيع التقليدي أحد المعيقات التي تواجه تطور عصر المعلوماتية واستخدام الانترنيت ، تم اللجوء إلى التوقيع الإلكتروني كون هذا الأخير واقعة مستحدثة فرضتها مقتضيات التجارة الإلكترونية ، لذلك اعترف التشريع الجزائري على غرار التشريعات الأخرى بحجية التوقيع الإلكتروني متى توافر على الشروط القانونية والضوابط التقنية التي تجعل منه توقيعا موثوقا بحيث منحه قوة في الإثبات تعادل قوة التوقيع التقليدي. The traditional signature is considered to be a hindrance to the evolution of thedigital age and to the use of the internet which has led to the electronic signature, asbeing a means imposed by the requirements of electronic commerce. Also theAlgerian legislation has, like other legislations, recognized the authenticity of theelectronic signature when the legal conditions and the technical clauses are met,conditions which make of it a sure signature giving it a force of proof equivalent to .traditional signature strength
