Résumé: ملخص: ساد الاعتقاد بأن عقود الإذعان تمثل التربة الخصبة التي تنمو فيها الشروط التعسفية وهي التي يكثر استعمالها من طرف الأقوى اقتصاديا، وهذا ما جعل بعض القوانين يقرر الحماية من هذه الشروط، لكن هذا لا يعني ارتباط الشروط التعسفية بعقود الإذعان، فهذه الأخيرة تتطلب احتكارا وتفوقا اقتصاديا حتى يطلق عليها هذا الوصف بينما تضمن العقود شروط تعسفية ليست محصورة في هذا النطاق فقط، فعقود الإذعان هي التي ينفرد فيها أحد طرفي العقد بتحديد شروطه وصياغة مضمونه، ولا يملك الطرف الآخر إلى القبول دون مناقشة ومفاوضة. Abstract: It was believed that compliance contracts represent the fertile soil in which arbitrary conditions grow and are frequently used by the economically stronger, and this is what made some laws decide to protect against these conditions, but this does not mean that arbitrary conditions are linked to compliance contracts, since the latter requires monopoly and economic superiority until It is called this description, while the contracts contain arbitrary conditions that are not limited to this scope only. Compliance contracts are in which one of the contracting parties determines its conditions and formulates its content, and the other party does not have the right to accept without discussion and negotiation.
