مبدأ التكامل من إشكالات العدالة الدولية الجنائية

Résumé: الملخص أنشئت المحكمة الجنائية الدولية الدائمة بموجب اتفاقية دولية (اتفاقية روما المؤرخ في 17 جويلية 1998) تسعى لتحقيق العدالة الدولية الجنائية أساسها إنهاء الحصانة و وضع حد للإفلات المجرمين الدوليين من العقاب، وكذا سد الثغرات القانونية التي وجدت في المحاكم الجنائية الدولية السابقة، وإرساء دعائم القضاء الدولي الجنائي ومنع ارتكاب الجرائم الدولية في المستقبل. إلا أن الواقع والنظام الأساسي الخاص بالمحكمة الجنائية الدولية لم يعالج الثغرات القانونية والنواقص التي كانت موجودة في المحاكم الدولية السابقة، وخاصة منها مبدأ التكامل بين القضاء الوطني الجنائي(الدول) صاحب الأولوية في المتابعة والمقاضاة وبين القضاء الدولي الجنائي(المحكمة الجنائية الدولية الدائمة) صاحبة الاختصاص التكميلي، فضلا عن غموض معايير انعقاد اختصاص المحكمة الجنائية الدولية، كلها في مجملها مجموعة إشكالات الموضوعية تعطل السير الحسن للعدالة الجنائية الدولية. Abstract: The Permanent International Criminal Court was established by an international convention (Rome Convention of 17 June 1998) that seeks to achieve international criminal justice based on ending immunity and ending impunity for international criminals, as well as filling legal gaps in previous international criminal tribunals, establishing international criminal justice and preventing future international crimes. However, the reality and the Statute of the International Criminal Court have not addressed the legal gaps and shortcomings that existed in previous international tribunals, In particular, the principle of integration between the national criminal justice system (States) with priority in follow-up and prosecution and the international criminal justice (Permanent International Criminal Court) with supplementary jurisdiction, In addition to the ambiguity of the criteria for the icc's jurisdiction, all of them are a set of substantive problems that disrupt the good course of international criminal justice.
