تحديات الحماية الدولية للاجئين البيئيين في ظل قواعد القانون الدولي/challenges Of The International Protection Of Environmental Refugees According To The Rules Of International Law

Résumé: تعتبر ظاهرة اللجوء البيئي واقعا تواجهه معظم دول العالم، خاصة مع التزايد المستمر والمتواتر للكوارث الطبيعية الناتجة عن تغير المناخ وتداعياته السلبية على حياة الأفراد في مناطق متعدّدة حسب ما تورده التقارير الدولية بهذا الشأن، إلا أنّ المجتمع الدولي يؤخّر دائما الاعتراف بمركز قانوني يوفر حماية للاجئين البيئيين، فلا نجد في فروع القانون الدولي أي نص صريح يقرّ لهم بذلك، هذا ما يدفعنا من خلال هذا المقال للبحث في الاسباب و العوائق التي تحول دون ذلك، واثرها على اليات الحماية التي يستفيدون منها التي غالبا ما تتسم بعدم الفاعلية، لأنها لا تستجيب لمتطلبات هذه الفئة. The phenomenon of environmental asylum is a reality faced by most countries of the world, especially with the continuous and frequent increase in natural disasters resulting from climate change and its negative repercussions on the lives of individuals in various regions, according to international reports in this regard. However, the international community always delays recognition of a legal status that provides protection for environmental refugees. We do not find in the branches of international law any explicit text that acknowledges that, this is what prompts us, through this article, to discuss the reasons and obstacles that prevent this, and its impact on the protection mechanisms that they benefit from, which are often ineffective, because they do not respond to the requirements of these Category.
