حدود تطبيق مبدأ عدم جواز الاعتذار بجهل القانون في ظل اعتبار جائحة كورونا (كوفيد - 19) قوة قاهرة

Résumé: من المبادئ الأساسية في فقه القانون الوضعي: " مبدأ لا عذر بجهل القانون"، ومؤداه أنه لا يقبل من أي شخص أيا كان الاحتجاج بجهله بحكم قاعدة قانونية للتهرب والإفلات من سريانها عليه، إذ يفترض العلم بها بمجرد نشرها في الجريدة الرسمية، لكن في ظل استحالة تحقق ذلك في حال قيام قوة قاهرة تحول دون وصول الجريدة الرسمية إلى جزء من إقليم الدولة لأي ظرف، يمكن الخروج عن هذه القاعدة، ومن بين تلك الظروف انتشار وباء يؤدي إلى عزل منطقة عن باقي اقليم الدولة، وهو ما ينطبق على الوضع الذي يعيشه العالم بسبب جائحة كورونا، في ظل فرض عزل صحي على الأفراد تجلت أثاره في انقطاعهم عن العالم الخارجي، ما يسمح بتكييفها بأنها قوة قاهرة تعطيهم حق التمسك بجهل القوانين الصادرة خلال فترة عزلهم. One of the basic principles in the jurisprudence of positive law is the principle that there is no excuse for ignorance of the law, and the implication is that it is not accepted from any person, whatever the argument of his ignorance by virtue of the legal rule, in order to evade and escape its application on him, as individuals are supposed to know about laws as soon as they are published in the Official Gazette. In light of the impossibility of real knowledge in the case of circumstances of force majeure that prevent the official gazette from reaching a part of the state’s territory, people can invoke their ignorance of the law. The spread of an epidemic that leads to the isolation of an area from the rest of the state’s territory is one of these circumstances. The situation the world is experiencing due to the Corona pandemic imposed health isolation on patients. Its effects were evident in their disconnection from the outside world, which allows it to be adapted as a force majeure that gives them the right to cling to ignorance of the laws issued during their isolation period.
