أثر جائحة كورونا على التزامات الناقل في عقد النقل الجوي للمسافرين

Résumé: لا تزال جائحة كورونا تشكّل موضوع الساعة بسبب أضرارها التي ألحقتها بمختلف القطاعات، ويُعدّ قطاع النقل الجوي للمسافرين من أهم القطاعات المتضرّرة من هذه الجائحة نظرا لتعليق جميع الرحلات الجوية، مما يؤدّي إلى صعوبة تنفيذ الناقل الجوي لالتزامه الرئيسي المتمثّل في نقل المسافرين في الفترة المحدّدة في تذكرة السفر. ويحق للناقل الجوي إعفاء نفسه من المسؤولية باعتبار أنّ عدم تنفيذه لالتزامه العقدي خارج عن إرادته. وتهدف هذه الدراسة إلى تحديد مدى إعفاء مسؤولية الناقل الجوي للمسافرين في ظل وباء كورونا، وسنستخلص التكييف القانوني لهذه الوباء. The Corona pandemic continues to constitute the topic of the hour due to its damages to various sectors, and the air transport sector for travelers is one of the most important sectors affected by this pandemic due to the suspension of all flights, which leads to the difficulty of the air carrier implementing its main commitment to transport passengers in the specified period in Air ticket.
