مسؤولية الناقل الجوي في تأخير المسافرين بسبب جائحة Covid-19.

Résumé: يعتبر الوقت من العناصر الأساسية لسير النقل الجوي، إذ لا يستقيم من دونه، فإقبال المسافرين والشاحنين عليه، مرده إلى السرعة التي تمتاز بها الطائرة والتي تنفرد بها عن باقي وسائل النقل، وأي إهمال لهذا العنصر سواء بتأخير الرحلات أو إلغائها سوف يرتب ضرر محقق للمسافرين. ولا شك أن هذا العنصر قد تم إخلاله مرارا وتكرارا من قبل الناقلين الجويين في زمن كورونا تنفيذا لإستراتيجية الاحتواء، وعليه فمسألة تعويض المسافرين بإقامة مسؤولية الناقل الجوي نتيجة عدم التزامه بالمواعيد المحددة سلفا في عقد النقل، تتطلب منا التقييم القانوني لجائحة كورونا كطارئة صحية لإثبات أو نفي مسؤولية الناقل الجوي عن التأخير. Time is one of the basic elements of air transport that passengers and shippers depend on it, due to the speed of its means, and any neglect of this element, whether by delaying or canceling flights will cause real harm to the passengers. In the time of corona, this element has been violated by air carriers in implementation of the containment strategy, therefore the issue of compensating passengers by assigning responsibility of the air carrier as a result of its failure to comply the predetermined dates in the transport contract, requires us to legally assess the Corona pandemic as a health emergency to prove or deny Air carrier's responsibility for delays.
