تسليم المجرمين على أساس مبدأ المعاملة بالمثل

Résumé: يعد مبدأ المعاملة بالمثل مصدر احتياطي لنظام تسليم المجرمين والذي يستند إلى سلوك متبادل من جانب دولتين قصد تسليم الأشخاص فيما بينهما رغم عدم وجود معاهدة للتسليم تلزمهما بذلك، ويعتبر إما مصدرا عاما حين يكون التسليم بين الدولتين دون وجود معاهدة تربط بينهما، وإما مصدرا خاصا إذا انصب على حكم من أحكام التسليم المنصوص عليها في الاتفاقية المبرمة بين الدولتين. يصعب اعتبار شرط المعاملة بالمثل مصدرا ملزما للدولة في مجال تسليم المجرمين باعتباره عبارة عن قيمة أدبية أو معنوية، لذلك لا يرتب مسؤولية الدولة في حالة التنكر له من جانب إحدى الدولتين ولو سبق للأخرى الالتزام به، ومع ذلك يكتسب قيمة قانونية لا يمكن تجاهلها حين يكون منصوصا عليه في المعاهدة التي تربط بين الدولتين لاسيما إذا كان يتعلق بمسألة لم تنظمها أحكام المعاهدة. The reciprocity principle is a subsidiary source for the extradition system; which is based on reciprocal behavior from both states for grant of extradition between them, notwithstanding the fact, however, that there was no extradition, treaty. And it is considered either a general source, when the extradition is grant between two states without any treaty, or a particular source if it is focused on any extradition’s provision stated in .the treaty concluded between the both states It is difficult to consider the reciprocity clause as a source binding on the state in the extradition, as it is an ethical and moral value; so that it ;does not give rise to liability for the state, in case that it will be denied by one of the state even if the other state was committed to it nevertheless, it acquires legal validity which cannot be ignored when it is stated by the treaty between the both states, especially when it concerns a question which is not governed by the treaty provisions.
