انعكاس اتفاقية سيداو على قانون الاسرة الجزائري – الخلع نموذجا – The Reflection Of The Cedaw Agreement On The Algerian Family Law - Khula As A Model –

Résumé: ملخص : لقد طرأ على قانون الأسرة الجزائري عدة تغيرات كنتيجة لانعكاس التحولات التي يشهدها المجتمع في مختلف مجالاته الفكرية والثقافية والصناعية والاجتماعية والسياسية والاتفاقيات الدولية التى صادقت عليها الجزائر ومن بينها اتفاقية سيداو, بناء على ذلك قدمت مشاريع بديلة لقانون الأسرة، مبنية على أساس المساواة بين الجنسين، وفي مجال تكریس المشرع الجزائري للضمانات التي أقرتها اتفاقیة سيداو لعام1979, جاء تعديل 2005لیجسد بمقتضى هذه الاتفاقیة الإلتزامات التي كفلها تشریع الأسرة الجزائري من أجل ترقیة الأسرة والمرأة والمتمثلة من خلال اعادة تعديل نصوص عديدة لمواده من بينها المادة54 حيث جعلت الخلع طریقا لفكّ الرّابطة الزّوجیة بإرادة الزّوجة مقابلا ومساويا لحق الطلاق الذى هو بارادة الزوج, وهذا التعدیل جاء استجابة لطلبات رفع الظلم عن المرأة . الكلمات المفتاحية : اتفاقية سيداو, قانون الاسرة الجزائري, تحفظات المشرع الجزائري, اثر الاتفاقية, الإجتهاد القضائي, الخلع Abstract : The Algerian family law has undergone several changes as a result of the reflection of the transformations that society is witnessing in its various intellectual, cultural, industrial, social and political fields and the international agreements ratified by Algeria, including CEDAW. The scope of the Algerian legislator’s dedication to the guarantees approved by the CEDAW agreement of 1979, the 2005 amendment came to embody the obligations guaranteed by the Algerian family legislation for the advancement of the family and women, represented by re-amending several texts of its articles, including Article 54, where it made khul’ a way to break up the marital union in return for the will and equality of marriage The right to divorce that is at the will of the husband This amendment came in response to requests to end the oppression of women.
